If I shoot someone with a paintball gun, is it illegal?

I would think so - assault and battery. The standard for A/B is surprisingly wide-open. :cool:

Almost anything can be construed as assault as long as the receiving person finds it offensive in anyway. You could very well be charged with assault for simply brushing up against someone out in public if they found it offensive. Whether or not the DA would be willing to prosecute is another thing but they could easliy arrest you for it.

If I remember correct I saw on the news a few months ago where Tom Cruise had this guy arrested for assault because the guy squirted him with a water pistol.

If I'm not mistaken it's not if the " intended victim" finds it offensive, it's if the victim presumes the action a threat or is in fear of bodily harm. Moonshine can sum it up I'am sure.
