its finally dry enough to walk down to the creek in my backyard and actually see what kind of damage the rain did, we ended up loosing 2 trees and about 10 ft of bank on the creek, we really need to divert the water into the new channel

Who has oversight over the creek?? You, homeowner's association, or the municipality?

The city said we are responsible for the creek and maintenance. But the reason the creek has become so bad over the years is all of the city's drainage from the streets gets tied into the creek
we are going to try that, I'm renting a backhoe to try and lift the tree out

What a crock of sh*t, they use your creek for their drainage (including oils, grime, trash, etc.), and yet it's your responsibility?? :hammer:
I'd tell 'em to either fix the damage caused by their runoff, or tell 'em to plug their access to it--or plug it yourself.
