View Full Version : Got a ticket... need some input

Got nailed this morning on the DNT by a trooper. Both of us were polite but I mentioned to the trooper that he stopped the wrong person. I was indeed going over the speed limit but 95 in a 60, no way. The traffic was moderate (as noted on the ticket) however at 7:20am this morning... there were plenty of cars with OU flags heading downtown.

The deal is a guy in a new Escalade was being a real jerk didn't want me to merge in and then accelerated to keep me out. I passed the guy and he was passing me back (which I backed off) and there was the trooper on the side of the DNT.

I told the trooper he stopped the wrong guy and I mentioned what had just happened... he told me next time just let the guy go by there are cameras on the entire DNT and they can get him if they needed to. My protest was noted on the ticket and wrote my up for speeding (95/60) but on the ticket it says "Alleged speed of 90". Anyone know what that means?

I have no idea what to do on this... this has to be a huge fine if I don't fight it.

Wonder if I should get a lawyer to bury it and get me out of it.

Anyone know what the fines are for 35 over?

The only violation on the ticket (beside the alleged 95) is "Speeding 10 percent above the posted speed limit (#)."

Lesson learned on this one is screw anyone trying to stiff ya in traffic and just let it run off your back. Had I ignored they guy completely he'd be the one with the ticket since he was hauling butt.

This one has me ticked... yes I was speeding.... no I wasn't going that fast, the other guy was passing me.

Suggestions (not for my driving habits but on the ticket :icon_smile:).

I'd definitely get a lawyer... and see if he can force the city/DNT to give up the tape as evidence if there are really cameras everywhere.

You can't do Defensive Driving or Deferred Adjudication at 35 over, so it will be a big ticket (probably over $400) if you don't fight it somehow.

Doug... When did we start a points system? Never heard of that in Texas.

Looks like an lawyer is going to be a must!

Lawyer up on this one and you should be fine

Lots of technicalities on the DNT the presumptive speed issue is one an attorney can work with

Good luck and buy a V1 and laser jammer

Right... I got a V1 but I need to upgrade it (has laser) and Terry has alaser jammer he has been trying to sell for a while (not the current version) but this will stop that from happening until I see how much this is going to cost.

Points system
The Driver Responsibility law (TRC § 708; Article 10, House Bill 3588, 78th Legislative Session) establishes a system which assigns points to moving violations classified as Class C misdemeanors and applies surcharges to offenders, based upon the type of offense and the time period in which the citation was received. For each conviction, DPS will assign points to a person’s driver record as follows:


Two points for a moving violation conviction in Texas or that of another state. Moving violations are defined by 37 TEX. ADMIN. CODE §15.89 (http://info.sos.state.tx.us/pls/pub/readtac$ext.TacPage?sl=T&app=9&p_dir=N&p_rloc=92809&p_tloc=&p_ploc=1&pg=19&p_tac=&ti=37&pt=1&ch=15&rl=51), which includes a list of those violations that will be assigned points.
Points will not be assigned for speeding less than 10% over the posted limit or for seat belt convictions.
Child Safety Seat Violations will accrue two points.
Three points for a moving violation conviction in Texas that resulted in a vehicle crash.

Points accrued remain on the driver record for a period of three years from conviction date. An offense committed prior to September 1, 2003 will not apply to the assessment of points under the program.

My Oklahoma ticket showed over 400 bucks for that fast. I guess calling a $45 attny would be a start but it is hell fighting the man:tex

Terry... after this is over and the smokes clears, we need to talk about that laser jammer if you still have it then.

And last but not least... I can change my driving habits which is the least expensive thing to do.

Some lawyers play the game well. One rescheduled the trial twice. 8 months later the cop had left the dept, FREE!
Once the lawyer asked the cop to identify the driver from a line up. He couldn't. FREE!

When you get your fine, send in a check to pay for it. If the fine

$79.00 make the check out for $82.00, some small
amount over the fine. The system will then have to send you back a
check for the difference.
However, here is the trick: DO NOT CASH THE REFUND CHECK!

Throw it away!


Points are not assessed to your license until all Financial
Transactions are complete. If you do not cash the check, then the
transactions are NOT complete. The system has received its money and
is satisfied and will no longer bother you. This information comes
from an unmentionable computer
company that sets up the standard databases used by every state.
Send this to everyone you know. You never know when
they may need a break.
