If this guy goes to jail or loses the lawsuit, we are screwed. Once again, the tail (or in this case, more like fecal matter) is wagging the dog. The "rich" land owner is the bad guy. :icon_rolleyes: Just another atrocity aimed at the conservative, business owning-type.

Agreed, and even if he wins, how much did going to court to respond to this lawsuit cost him vs the Mexican nationals? will he be able to counter sue them or the Defense fund? probably not.. :mad:

The illegal Mexicans are claiming violation of their Civil Rights, it looks like. But, aren't Civil Rights only afforded to US Citizens and not illegals?

Apparently not, then think about the combatants that are being held at Gitmo.. isnt the issue there Civil Rights and the right to a speedy trial? yet they are not on US soil..

I am thinking I would have all kinds of rights in foreign countries.. :rolleyes:

Just face it. The crooks are making the laws now. In New York if some one brakes in you house, the law stats you must leave your house instead of defending your self and property. Who else but a thief would pass this law.

What judge other than a thief would allow the law suit by the criminals to continue? Will this man not be allowed to protect himself and his lively hood from now on?

The only thing this, and other laws, and judgments like this, is going to lead to is total anarchy, and/or another revolution, to take the country back from the thief's!

To me what this hinges on are what exactly your rights are in making a citizen's arrest. Do you have the ability to intimidate or threaten someone in order to detain them while authorities are summoned?

It will never hold water, he has the right to defend life, limb, and property...and since they are not even citizens in the first place they have no civil rights. No tresspassing signs in english and spanish.....:throw:

I was watching tv and had an attorney say this... just leave the house.. WHAT? what if I cant get out? what if there are more than one of them? the moderator at that point said, they would take them out.. if they come in to MY house, you take them out.. at least if they are dead, they can not testify in a court of law..

I don't disagree with ya Jimmy. But the courts are ruling in the favor of the aliens time and time again. The latest mess in Farmers Branch over the apt leases in just one example. Irving PD was turning them over to INS after traffic stops and a circuit court has stopped that. The courts are giving them civil rights each time they rule in favor.

DanaJust one more example of why U.S. needs to change the tort system to "looser pays" like the rest of the world. Hopefully a jury made up of the land owner's peers will not grant the plaintiffs a dime.

and if it was loser pays, the defense fund would have to pony up the entire court and legal expense for both parties..

They lost in the Fed court, though. This will eventually get overturned, I'd imagine with the appeals process. Still makes for a royal PITA for a 66yr old rancher, though. He may spend the last years of his life fighting court battles during the week, and then going out to his ranch on the weekends and rounding up more illegals.
