I watched the dashcam video - the cop is a dick, plainly.

He will lose his job with Dallas PD IMHO. I think the lynch pin will be the "I can screw you over" comment.

I also agree he has achieved A$$clown status in my book

I would not have blinked an eye to that cop. His mother in law died while he sat and talked to the douche... It is a very sad thing...

+1, Let the man go see his family. If your that hard-up to write a ticket catch up to him later. Gotta give the Chief props for standing up like he did.

Exactly!!!

When you have Hosp. security and nurses telling you that the mans mother-in-law is seconds away from dying, escort him inside, let him see her, and then if you are still wanting to give him a ticket do so. But let man see his mother-in-law

The "I can screw you" and "I can make your night very diffucult" comments were not needed.

I hope the cop does get fired

The article I read said the other man in the video with Moats was either the dying womans husband or father

I would have just ignored the cop all together and walked into the Hospital, but I haven't been one to make the right decisions in situations like that anyway.....

I totally agree! It really pissed me off when I watched that. I think if it was me, I would have just walked into the hospital like the 2 women did.

what alot of people don't know is that the cop pulled his piece on him, not alot of walking away he could do.. Seems the cop was aching to shoot are beat someone, tossed off the force seems what's needed!!!! No matter skin color no one deserved that, he should sue the city for improper training!!

The man was unarmed. If he would have pulled his weapon on me, I would have raised my hands and said I am not armed and walked into the hospital with my arms in the air.

and what you cant see in the video is the hosp staff met him at the front doors and told him she passed away

he already said he is not going to sue

Should he lose his job?

Putting aside the anger I got by watching that, my logic is that if you were the police chief would you trust this cops judgement in a possiblly life threating situation that involved other people. What if it were you or your family in that situation? The judgement this officer used in this situation is so far beyond inexcusable it likely borders on criminal. IMO The Moats family is more than justified in persuing civil litigation against this officer, and if the DPD were smart they should distance themselves from this officer as fast as possible.

i thought you were serious for a moment too. he was an ass for sure. i'll give him the benefit of the doubt on the race thing though. nothing pisses a cop off more than not pulling over right away. i know this from personal experience. i got caught speeding near the shop one day and decided to proceed around the corner and drive into our driveway and park. he followed and actually drew down on me in front of our office. :icon_eek:

The big question is after this much attention - how can a DA use him in a prosecution?

If I got pulled over by him, I would gladly contest the ticket, let a jury decide whose word is worth more.

I can see the cop's point of view in the beginning (read before shooting!) since they probably get every story in the book for traffic offenses, and passengers wandering around can really lead to a bad situation. Cops can't always sort through the BS people give them and a skinny guy like that trying to control a guy twice his size has to bark pretty loudly.

With all that said, he was way out of line by not letting them go when he was notified of the situation. He could have taken their licenses and let them leave, then return them after he was done checking them out or writing a ticket, if he decided that was still necessary. As far as I know TX law doesn't allow arrest for most common traffic violations, and threatening to arrest the passenger for running a red light is just BS.

I really feel bad for them, they missed a final moment with a parent and that can never be taken back. I don't follow football and I never heard of Moats before this, but I have to give him credit for keeping his cool. I am not sure I could have done the same in that situation, especially if I felt that I was being discriminated against. He seems like an ok guy in my book, he didn't even try to pull the celebrity card.

This cop has a god-complex and didn't hesitate to abuse his power. Both indicate burnout or instability and both are bad qualities for someone who carries a gun. If they don't fire him they definitely need to discipline him and force him to take some sensitivity training on dealing with the people he is supposed to protect and serve.

All cops have to deal with the scum of the earth daily and watch criminals get released despite their efforts, it will definitely affect your viewpoint over time. They can easily get jaded and adopt a paranoid view that everyone is a criminal, when in reality most people aren't that bad. These guys need some perspective and regular training to combat that perception, and if they continue to exhibit a bad attitude then they just need to be let go. It will be healthier for them to find a new profession and safer for the public and their partners to get the bad ones out before they sour the rest.

Just my twenty pesos.

As this thing unfolds I am sure he now realizes he has made a monumental error in judgment.

I think he will ultimately be fired or resign from the DPD.

He is young and if nothing else comes from this he will be greatly humbled and may turn out to be a good law enforcement officer because of it.

I tried to think what would happen if some of my bad judgment from my early twenties was on national news.......:tex

PS: he is still currently an A$$clown in my book

See, I have heard the opposite, that they have wide discretion over what is an arrestable offense. I have even heard they can take you to jail for a seatbelt violation if they wish.

If only there were someone in the club that could shed some light on this...

You can be arrested for anything. Most officers use good judgment and take in to consideration the totality of circumstances.

I am sure Brian will weigh in and give us the LEO answer. I would be interested in his opinion of this incident

You cannot be arrested for speeding. But the loophole is you can be arrested for reckless driving. So they just deem your actions reckless and there you go!

1. Mike made a good point that cops get lied to so frequently that you become very cynical. Unfortunately, after this incident, every other person that gets stopped for a traffic offense will claim they're on their way to see their dying mother.
2. Despite #1, the fact that the violator pulled into a hospital parking lot should have been a clue that this violator may have been telling the truth. A quick phone call could have verified that he had terminally ill family, and then a reasonable officer would cut him loose. IMHO, no ticket, and no further detention. So yes, this officer deserves to get smacked for exceedingly poor judgment.
3. Does he deserve to get fired? Hmmm, that's tougher to figure out. Is he just young, inexperienced, and a little too gung ho, or is he incurably stupid? I don't know, but I do know that his threats are very unprofessional, and I'd never say the things he said on that stop.
4. Most, but not all, traffic offenses in Texas are arrestable. Speeding, no. Open container, no. Just about everything else, including no seat belt, yes.

I think that's my $.02 on all the questions posed so far.
