"I can't help you out with pictures, because I don't have any. But I can give you some more details. I was turning onto a road that has a 55 mph speed limit. There was a blue L way down the road coming up on my pretty fast. He was punching it because I could hear the whine of the supercharger. I got out onto the road just fine, and was about 1/4 mile ahead of him. The guy behind me also turned onto the road, but didn't realize that the L was coming that fast. He pulled right out in front of him and the L crashed into the back of the car. The guy really shoudn't have pulled out because the L was flying. The thing that really sucks is in Texas, if you hit someone from behind, it is your fault, no questions asked. The L probably was going over the speed limit, but that dude shouldn't have jumped out in front of him. Either way, the L is at fault. That really sucks. I wanted to stop and make sure everything was ok, but I had an exam in my class in ten mintues."

Wow, that bites. :( However, if you have witnesses that show that the car pulled out in front of the vehicle that does the hitting, you *can* get that fault reversed. Since it'll be up to the insurance companies anyway, what the law or the police report say will be moot, unless there were serious injuries, and the witnesses say the L was speeding. :(

I told him on the F150 post that he broke the law by not stopping.

Are you sure?....I thought if you witnessed the accident you were required to stop and assist.

Just finished a class conducted by a lawyer and he is correct. You have to be involved in some way before the "stop and render aid" provision applies. Doesn't seem right to me either, but you can apparently witness a crash and not be required by law to stop and help. :cool:

I had a strange one happen to during the summer of 2003... heading to a men's breakfast I came off the tollway heading east on LBJ... some dude behind me in a Suburban tried to keep up with me (I sort of accelerated fast coming off the tollway). I decided to back off not knowing where the guy was and I hear a vehicle accelerating from behind me and all of a sudden the guy is in front of me and slams on the brakes and locks it up (older Suburban). The guy spins 180 degrees and is now facing me and we are both going 70+mph... he drifts to the right, I pass and keep going. Looking in my mirror I see the dude keep going off to the right, lose site of him and then see the car flip up off the guard rail with smoke and dust everywhere.



Damn... thinking it was strange I pulled off to the side. Waited for a couple of minutes, called it in and decided to go see what happened. Took me quite a while to get to Coit and head back to Preston for the u-turn. Officers were already there and when I pulled up and told them what I saw they told me to pull up to the accident and speak to the officer... but first they had to inspect my truck. Get this... eyewitnesses told them that I hit the guy and caused the accident. It was close but nowhere near that close. After they looked at my truck, took my statement and asked a few questions, they let me go.



My point is witnesses don't mean squat... there wasn't a scratch on my truck but yet they were about to put this down as a "Hit and Run". Witnesses even told them that I pulled off to the side of the road for a while and then sped off. I will always stop; if you are near an accident I suggest you do too. One to help sort out the story and more importantly to make sure everyone is okay.



I hope everyone recovers from the accident.

wasn't me but i was up that way, in my damaged L. It's finally in the shop getting fixed.

think about it.... If required to stop and render aid.... What prevents that person from sue'n you for causing more injury from helping him?.... after saying that..... whats the qualifying factor that one may render help... so therefor... all are required to be trained to stop and render aid? ...... .... it just gets more silly the deeper i go into it.....

I do believe sworn professionals EMT's, Para's. are suppose to act if no one else has reached the scene:confused: . The good samaritan act is suppose to protect you from liabilities of helping someone out.

I took safety and first aid at junior college, and technically being safety and fird aid certified, I could get in trouble for not offering help. You are protected by the good samaritan act when it is judges that you are in your best interest trying to help the person I believe.

My wife and I became certified SCUBA divers years ago and the first aid part of the process was very interesting...

We were taught that if we didn't render aid and it was found that we were qualified we could then be subject to possible legal action... that has been years ago though.

I've always stopped and always will. I guess it's because I'd like someone to stop and help me if I needed it. Sort of what goes around comes around.

You stop and think about it. Just being a human being is enough to render aid. Call 911, hold a broked arm so it won't move. Anything is better than driving by and not stopping. Single car accident, unconcious driver bleeding to death and nobody stops to render aid. An even better situation. A girl I work with was driving home a few months ago and a Lewisville police officer was involved in an accident which crushed the front/roof of his cruiser. She stopped and ran up to the scene and passed two guys going the other way and they told her not to go up there "that guy is f@cked up" She went anyway and he was unconcious with a skull fracture and occluded airway, which she opened and saved his life. Props to the two jackasses who ran the other way.

That's an awesome story. Someone give that girl a medal. I hope that the city of Lewisville recognized her for this life saving action.

Well, here's another Good Samaritan story as I'm thankful to my Dad's cousin and another few individual(s) whom I don't know their identities.

Keep in mind, I'm not posting this to "gross" anyone out, as this is pretty hard for me to type. :(

Back in '86, Mom was in a very bad industrial accident and her right-arm was twisted off approx. 25 times. Mom was laying on the ground barely conscious and remembering people running up to her and running away screaming.

Mom says she can remember my Dad's cousin and a couple of others there grabbing Mom up and laying "something" across her stomach :( and running her to medical and to an awaiting ambulance.

The human body is amazing! Mom says she can remember the medi-flight helicopter pilot turning around as they were about to lift-off and telling Mom that the take-off maybe a bit bumpy.

Different story - years later, my brother Regan was at the neighbor's house near the highway back home and they hear this terrible crash. They run up there and this Ford F-350 with tons of oil-field sucker-rod on a "goose-neck" trailer ran off Hwy-70 and landed with the dually upside down, with a pile of sucker-rod on top of the dually and goose-neck.

The guys under all that mess in there screaming back to them that he's pinned in, hurt bad and the diesel saddle tanks are busted and running everywhere in the cab/truck.

Regan runs to the other neighbor's and grabs a "cherry picker" they're called - it's like a big crane with 4 huge wheels.

Anyway, Regan gets the cherry-picker and lifts the rod and trailer off the dually and OHP and the ambulance take the guy away.

The cool thing was Channel 12 out of Denison/Sherman/Ardmore covered the crash and hooked up this guy (when he got out of the hospital), Regan and a few of his buddies that helped for a "thanks alot" follow-up piece. It's on video somewhere at Regan's.

I actually met the guy, too as they were filming - he was torn up pretty bad even then.

Anyway, that's my "Good Samaritan" story. I always try to help people out when they need it and I'm glad there are others out there that do likewise.:)

They did. She received awards from the City, PD and FD.
